Appellant filed a claim before the board of commissioners of Clark county for a refund of taxes, which was refused. Appellant appealed to the circuit court, where a demurrer was sustained to the claim. And from that ruling this appeal is prosecuted.

The salient facts are, in substance, as follows: On and prior to February 13, 1923, the United States of America was the owner of, and in possession of, certain personal property and had the same stored in its Quartermaster's Depot in Jeffersonville township in Clark county.
