Respondent was a passenger on appel*120lant’s train between Spokane in tbe state of Washington and Bossland, British Columbia, and sned to recover damages for injuries alleged to have been sustained while such passenger, as a result of appellant’s negligence. In the lower court, prior to the commencement of the trial, defendant made an application for an order directing that the plaintiff be examined by medical experts appointed by the court, for the purpose of ascertaining the nature, character and extent of plaintiff’s injuries.
