In June, 1945, a petition was filed pursuant, to the provisions of sec.'60.302 (1), Stats. The petition was in due form and complied with the requirements of sec. 60.302 (3) and (4). The town board fixed a time and place of hearing upon the petition and gave notice thereof as provided in sec. 60.303 (1) and (2).
Sec. 60.303 (3), Stats., provides: “Upon the hearing, if it shall appear to the town board after consideration of all objections, that the petition is signed by the requisite owners of real estate as providedin subsection (1) of section 60.302, and that the proposed work is necessary,…
