delivered the opinion of the Court:

The questions raised on this record arise out of the following facts: John Watt commenced an action of assumpsitin the Cook circuit court, on the 13th of January, 1873. against Charles W. Allen and Almond D. Ellis, wherein, on the 29th of March, 1873, a judgment was rendered against them for the sum of five hundred and forty-seven dollars and sixtv-six cents, together with the costs.
