1. On the call of the case in this court a motion was made to dismiss the bill of exceptions, on the ground that it was tendered more than thirty days after the rendition of the judgment and the adjournment of court. The bill of exceptions recites that it was presented within the period allowed by law, and there is nothing in the record to negative the fact that, although the bill was certified more than thirty days after the judgment complained of, it was not presented within the statutory period.
