I. INTRODUCTION
This cause is before the court on Defendants’ Motion to Dismiss the City of Montgomery from Counts I, II, III, and IV and Individual Defendants, Officers G. J. Marshall, Lizenby, and Fictitious Defendant, Officer A, from Counts I and IV of the Plaintiffs First Amended Complaint (Doc. #20).
