Defendant appeals his conviction for second-degree murder, a Class B felony, K.S.A. 21-3402, claiming that the trial court erred in: (1) refusing to find that his statutory and constitutional rights to a speedy trial had been violated; (2) refusing to either compel a codefendant, whose trial had been severed, to testify or to admit the transcript of the codefendant’s testimony from his separate trial; (3) excluding hearsay testimony at the motion for new trial; (4) permitting a State’s witness to testily as to an out-of-court statement made…
