This matter comes before the Court on the motion of Safeco Insurance Company of America (“Safeco”) for summary judgment pursuant to Federal Rule of Bankruptcy Procedure 7056, which incorporates by reference Federal Rule of Civil Procedure 56, on the complaint filed by Walker Nell Consultants, Inc., not individually, but solely in its capacity as the trustee of the plaintiff, Big Idea Liquidating Creditor Trust (“Creditor Trust”) which seeks declaratory judgment against Safeco and Lyrick Studios, Inc.
