In a proceeding pursuant to CFLR article 78, inter alia, to review a determination by the Nassau County Civil Service Commission dated June 25, 2008, which disqualified the petitioner from the application process for a position as a Nassau County Correction Officer, the appeal is from a judgment of the Supreme Court, Nassau County (Woodard, J.), entered December 11, 2009, which granted the petition and vacated the determination.
Ordered that the judgment is reversed, on the law, with costs, the determination is confirmed, the petition is denied, and the proceeding is dismissed.
