This was an action by appellants against appellee for commissions- claimed to be due to the former from the latter on a sale of real property. The court instructed the jury peremptorily to find the issues for the defendants, which the jury did, and judgment was rendered against appellants. The question presented by the instruction of the court is whether the evidence tended to prove the plaintiff’s case.
