OPINION

GOLDBERG, Justice.

In the early morning hours of April 5, 1994, the plaintiff, Mary Seide (Seide or plaintiff), and two friends were driving home to Boston after spending the weekend in New York City celebrating Easter with her family and her church. As Seide slept in the passenger seat of her vehicle, the impact of a collision with a stolen flatbed tow truck jolted her awake. This car wreck was the final act in a sustained, high-speed police pursuit spanning three communities and involving several police departments.
