Appeal by the defendant from a judgment of the County Court, Suffolk County (Tisch, J.), rendered March 21, 1985, convicting him of sodomy in the first degree and sexual abuse in the first degree, after a nonjury trial, and imposing sentence.

Ordered that the judgment is reversed, on the law, and S.C.I. No. W-78/85 is dismissed, without prejudice to the People to re-present any appropriate charges to another Grand Jury; and it is further,
