Judgment, Supreme Court, Bronx County (Martin Marcus, J., at plea; John Collins, J., at sentence), rendered January 22, 2003, convicting defendant, after a plea of guilty, of criminal sale of a controlled substance in or near school grounds and sentencing him to 4½ to 9 years, unanimously affirmed.

Under the circumstances presented, where a defective indictment was dismissed with the understanding that the People would be granted leave to re-present evidence to a new grand jury if no plea agreement were reached, there was nothing unlawful in defendant’s waiver of indictment and plea of guilty…
