The court erred in instructing the jury that what was said in relation to the brands and marks of Vail Bros., not being recorded, was immaterial in this case. Until the act of 1885 was passed, the evidence in this case-to show that Vail Bros, were the owners of these cattle was not even prima facie evidence of ownership, much less proof beyond any reasonable doubt, as was necessary to authorize defendant’s conviction.
