E. C. Ottinger, doing business as Ot-tinger Construction Company, held a prime- contract with the United States for the construction of thirty-seven powder magazines and the necessary roads, railroads, loading docks, and related work upon the premises of the United-States Naval Ammunition Depot in Mc-Alester, Oklahoma. This action was brought for the use and benefit of C. W.
