Cities Service Oil Company (Cities Service) filed a Petition for Declaratory Judgment and for Mandatory Injunction against the Board of Supervisors of Fairfax County and other county officials. It was alleged in the petition that Cities Service was the owner of a tract of land in Fairfax County and that the county Board of Zoning Appeals had issued a special use permit to City Engineering and Development Company, Inc.
