The object of the suit was to determine whether the appellants, who were the plaintiffs below, or appellees, who were the defendants below and in possession of the property, were the holders of the superior legal title to the property in question when the suit was commenced. The contention of appellants is, that the Moline State Savings Bank, which foreclosed the $6000 mortgage and purchased the property at the sale, and Porter Skinner, the assignee thereof and testate of appellees, who received the assignment of said certificate of purchase from said bank, were parties complainant in the suit of the Rock Island National Bank et al. against the J. S.
