There have been two trials of this case. On the first trial the jury found for appellee and assessed her damages at the sum óf $5,650, and judgment was rendered'on the verdict. The appellant appealed from that judgment to this court, and we affirmed the judgment at the October term, 1903, of the court, and appellant appealed from the judgment of affirmance to the Supreme Court, and that court reversed the judgment of this court and the trial court remanded the cause to the trial court.
