This is an appeal from a judgment in replevin in favor of appellee and against appellant. The case was tried by the court without a jury.

The property in controversy is a team of horses sold by appellant to George and Ida Larding, on October 8, 1902, and a set of harness sold by appellant to said Ida Larding on October 15, 1902. Appellant immediately delivered the property to the purchasers and they continued in possession of same until it was levied upon by appellee.
