Defendant, Dino Titone, appeals from circuit court of Cook County Judge Earl E. Strayhorn’s partial dismissal of his post-conviction petition wherein Judge Strayhorn, without conducting an evidentiary hearing, dismissed the defendant’s claims that he was denied due process at trial and during his first direct appeal to this court. Judge Strayhorn granted the portion of defendant’s post-conviction petition seeking to vacate the defendant’s death sentence. No sentencing issues are raised by this appeal. This court previously affirmed the defendant’s convictions and sentence on direct appeal.…
