OPINION

KENNEDY, Justice.

This is a personal injury suit based on allegations of both negligence and strict liability in tort. Appellant was employed by Southern Pacific Transport Company of Texas & Louisiana (Southern Pacific) as a “city driver.” Southern Pacific, a trucking company, is a wholly owned subsidiary of Southern Pacific Transportation Company (commonly known as the Southern Pacific Railroad, which will be referred to herein as “the railroad”), appellee in this Court.
