MEMORANDUM AND ORDER

YOUNG, Chief Judge.

The plaintiff Alan Ziskend (“Ziskend”) brings this suit against Brookline’s Chief of Police, Daniel O’Leary (“O’Leary”) in his individual capacity, alleging violations of 42 U.S.C. § 1983. 1 In Count I of his complaint, Ziskend alleges that O’Leary retaliated against him in violation of his First Amendment rights by dismissing him as an auxiliary police officer after Ziskend brought suit against O’Leary and the Town of Brookline.
