CONTIE, District Judge.
Defendant has moved the Court to strike various allegations contained in the complaint. Upon consideration and for the reasons stated below, the complaint shall be dismissed with leave to amend.
This is an action pursuant to Section 309(d) of the Federal Water Pollution Control Act, as amended, 33 U.S.C. Section 1319(d), to collect civil money penalties for alleged violations of a National Pollutant Discharge Elimination System (hereinafter NPDES) permit and of an Order by the Environmental Protection Agency (hereinafter E.P.A.).
