William Sarkis and William Thomas severally appeal from convictions of aggravated assault and battery. The cases were tried together and so argued here, and will be disposed of in one opinion. In the same trial Lawrence Nardini was acquitted.

In the early morning David, Johns (the victim) and Donald Tannous were proceeding eastwardly in an automobile on the Boulevard of the Allies in Pittsburgh. A car driven by Nardini, with the defendants, Sarkis and Thomas, passed, and both cars stopped. Nardini remained in his car and the other men gathered at the corner of Smithfield…
