AREND, Justice.

The appellant, Natividad Salinas, was tried by jury and convicted in the District Court for the District (Territory) of Alaska of the crime of arson in the second degree. He appealed from the conviction to the United States Court of Appeals for the Ninth Circuit. While this appeal was pending he moved in the trial court, on January 4, 1960, for a new trial on the ground of newly discovered evidence.
