This case involves the right of the plaintiff to take a nonsuit.' The trial judge sustained a motion for a nonsuit at the conclusion of the plaintiff’s evidence and at a time when the defendant’s motion for a directed verdict was being discussed but not actually announced. The Court of Appeals affirmed the trial court. The defendants have petitioned for certiorari, complaining that this was error.
