WINGATE, District Judge.
Before the court are the motions of both plaintiff and defendant for summary judgment brought pursuant to the Federal Rules of Civil Procedure, Rules 56(a)1 and (b),2 respectively. Plaintiff here is Sandria F. Walker, a former employee of Wal-Mart Stores, Inc., (“Wal-Mart”), and a participant in Wal-Mart’s self-funded employee welfare benefit plan (“Plan”).
