MEMORANDUM AND ORDER

This matter is before the Court upon the defendants’ Motions for Summary Judgment pursuant to Rule 56, Federal Rules of Civil Procedure, on the ground that the plaintiff’s alleged cause of action is barred by the applicable statute of limitations. The Motions were heard by the Court in Statesville on October 31, 1974 and, upon consideration of the Amended Complaint, the deposition testimony of the plaintiff, the affidavit of William J.
