By WICKHAM, J.

Stiles Fry was the owner of 23 acres of land in Orange Township, Delaware County, and was in ill health. He had no other property and his funds were exhausted, and he discussed with his son, the defendant, "William A. Fry, the question of selling his property or part of it. The defendant said that he would support his mother and father the rest of their lives and pay their funeral expenses and Stiles Fry said that if the defendant would do this he would deed the place to him.
