Deceased and appellant had been friends personally and in business relations. Some time, however, prior to the homicide there came a difference between them, minor at first, but more acute and of more magnitude as matters progressed. Deceased was rather aggressive in his hostility to appellant, engaging him at least once in a personal encounter, followed by threats of violence. These threats, or some of them, were communicated to appellant. This caused appellant to avoid contact with deceased, and he would evade or turn away when the prospect of meeting him occurred.
