DAVIDSON, Presiding Judge.

Appellant was convicted of manslaughter, his punishment being assessed at two years confinement in the penitentiary.

The deceased was named Jim Smith. Father of deceased was A. P. Smith. ' The city of Waco owned a block of land about 300 feet square in the suburb of said city known as Edgefield. There was a brick residence on the block of land. There was also a barn situated on a different portion of the block. A. P.
