This is an- appeal from a conviction for burglary and grand larceny. The information charged that the defendants feloniously broke into a granary in Dickinson county, on the night of April 19, 1888, with intent to steal, *267and did steal one hundred bushels of oats of the value of $40, the property of Elmer Clemens.
