This proceeding was instituted in the name of the defendant in error for the purpose of condemning certain lands of the plaintiffs in error for railroad purposes. Numerous errors are assigned, but in the view we take of the case only one of them need be considered.
Prior to the appointment of commissioners to ascertain the compensation to which the defendants were entitled for the land sought to be taken, and the damages to the residue of the tract, the defendants filed several pleas, among them one denying all the allegations of the petition and notice, and called for proof thereof.
