This is an appeal from a partial summary judgment. Appellant, Annie L. Saxer, sued appellees 1 under the Deceptive Trade Practices — Consumer Protection Act, Tex.Bus. & Com.Code Ann. § 17.50 (Supp.1984) (hereinafter referred to as DTP A), for mis representations and nondisclosures allegedly made in connection with the sale of a home in Austin, Texas.
