LEAVY, Circuit Judge:
Petersen, a seaman, brought this action to recover wages withheld by Interocean, his employer, in violation of 46 U.S.C. §§ 10313(f) and 10314(a)(1)(A), and for penalties under 46 U.S.C. § 10313(g). 1 On cross-motions for summary judgment, the trial court found that no genuine issue of material fact existed to dispute that: 1) Petersen accepted payment in settlement of his first wage claim, and 2) Interocean had sufficient cause for withholding Petersen’s pay.
