OPINION

ESQUIVEL, Justice.

This is an appeal by writ of error from a default judgment entered in favor of appel-lee, Ben Katz (Katz), against appellant, Pharmakinetics Laboratories, Inc. (Phar-makinetics). The pertinent facts are as follows:

On August 29, 1985, Katz sued Pharmak-inetics for damages, attorney’s fees and costs which resulted from a breach of a real estate lease. Katz maintained Phar-makinetics failed to pay rent and damaged the leased premises.
