Presently before the Court are the following two motions: (1) a motion by the defen*70dant Nationwide Mutual Insurance Company (“Nationwide” or the “defendant”) to strike the legal arguments from the reply affidavit of D. Brian Hufford; and (2) a motion by the plaintiff Stephen R. Steinberg (“Steinberg” or the “plaintiff’) for class certification pursuant to Federal Rule of Civil Procedure 23 (Fed. R. Civ.P.”).
