Mr. Justice Lamar,
after stating the facts in the foregoing language, delivered, the opinion of the court.
The main grounds of the bill are :(1) That the agreement or conveyance of May 14, ,1869, was never delivered, but was only a paper in contemplation to be executed, and that the execution and delivery of it were finally abandoned ; and
