This is a case about a gun that could not shoot. Defendant-appellant Pedro Rivera appeals from a judgment of the United States District Court for the Southern District of New York (Gerard E. Lynch, Judge) convicting him, following a jury trial, of unlawful possession of a firearm by a convicted felon, in violation of 18 U.S.C. § 922(g)(1). On appeal, Rivera argues (1) that the jury’s verdict was not supported by sufficient evidence because the defective weapon in question did not meet the definition of a “firearm” set forth in 18 U.S.C. § 921(a)(3), and (2)…
