This is an election contest over the office of justice of the peace from the Ninth Civil District of Davidson County. The county court decided in favor of Brown. The circuit court, on appeal, decided in favor of Hows, and Brown has brought the case to this court.

There were two magistrates to he elected from the aforesaid civil district in the election held on August-7, 1930. There were three candidates. According to the returns certified by the election officers, M. C. Hicks received 194 votes, A. R. Brown received 154 votes, and S. P. Hows received 153 votes. There is no contest over the…
