Thq only question in these cases, is, whether the assignment from vi&raAa??¿ Frear to James Morrison, of the 13th of September, 1800, and endorsed • on the lease from Stephen Van Rensselaer to Frear, of the 22d of September, 1790, is fraudulen t and void.

If the facts stated by the "subscribing witness to this assignment, are true, there can be no doubt that a gross ,and unexampled imposition has been practised on Abraham Frear, who, it is alleged, executed it.
