Respondent, the Department of Higher Education (the Department) of the University of Colorado at Colorado Springs (the University), appeals an order of the State Personnel Board (the Board) which affirmed an order of the Administrative Law Judge (ALJ) in favor of complainants, Shirley G. Hughes, Carolyn Curry, and Ann Reeverts. In her decision, the ALJ determined that the University’s act of abolishing Hughes’ position, which impacted Curry’s and Reeverts’ positions, was arbitrary and capricious.
