The bill was filed under the Declaratory Judgments Law to have a deed construed and determine the rights of the parties. The deed which was executed April 5, 1867, reads:

“This deed of conveyance made by George W. Gibbs of the County of Obion, and State of Tennessee, of the first part, and the Nashville & Northwestern Railroad Company of the second part, witnesseth that the said George W.
