Samuel Lee Felder was indicted for the intentional killing of Elbert Lee Jackson during the course of a robbery in the first degree, in violation of § 13A-5-40 (a)(2), Code of Alabama 1975. The jury found the appellant "guilty as charged in the indictment" and recommended the appellant be sentenced to death. After independently weighing the aggravating and mitigating circumstances of this case, the trial judge accepted the jury's recommendation and sentenced the appellant to death. See Appendix A, hereto attached and made a part hereof.
