THIS CAUSE came before the Court upon Defendants’ Motion to Dismiss the Complaint filed on September 18, 1992.

THE MATTER was referred to the Honorable Barry L. Garber, United States Magistrate Judge. A Report and Recommendation filed December 18, 1992, has been entered recommending that the Defendants’ motion to dismiss be granted.
