DORE, Judge.

The suit is to recover damages in the sum of $6,066.40. The plaintiff alleges that on June 13, 1933, about the hour of 10 o’clock p, m., the gasoline in his 1931 model Ford coupé gave out a short distance east of the village of Broussard, on the Old Spanish highway; that one Ewing arrived on the scene where his car was stopped and consented to and did push plaintiff’s said car into the village of Brous-sard up to the filling station in question; plaintiff blew his horn several times in an effort to get defendant’s agent or employee to serve him with gas; that shortly an attendant…
