We will first consider the contention of appellant that ■ a peremptory instruction should have been given by the trial court directing a verdict in his favor.
The record shows that after the evidence was all in and while counsel were discussing motions before the court, defendant’s counsel stated that he desired to enter a motion for a verdict for the defendant, which motion the court denied.
