This adversary proceeding is an outgrowth of a massive fraudulent Ponzi scheme perpetrated by Michael Berger, a convicted felon and fugitive. As set forth below, three United States District Court Judges, this Court, the Supreme Court of Bermuda, and the High Court of Justice of the British Virgin Islands have been called upon to parse out the sequela of the Manhattan Investment Fund (the “Fund” or the “Debtor”) Ponzi scheme.
