PATRICK E. HIGGINBOTHAM, Circuit Judge:

The Veterans Administration Medical Center in Waco, Texas on April 17, 1986 fired Irwin, an employee. He contacted an Equal Employment Opportunity Counselor on June 12, 1986, and later filed a complaint with the Veterans Administration. The VA rejected Irwin’s claim on the ground that he failed to contact an EEO Counselor within thirty days of the alleged discrimination. 1 Irwin appealed to the Equal Employment Opportunity Commission, which affirmed the VA’s decision.
