The plaintiff in error, First National Bank of Duncan, will be referred to as defendant, and C. C. Worrell, defendant in error, will be referred to as .plaintiff, as they appeared in the trial court.

The plaintiff commenced this action against the defendant bank and other defendants in the district court of Stephens county, by filing his petition therein on the 27th of January, 1921.
